Terms and Conditions

Effective Date: September 20, 2025

SERVICE PERFORMANCE:

Due to Florida's climate and pest environment, total eradication of pests is not guaranteed. Ban-A-Bug agrees to use industry best practices and approved products to control the pests covered under this agreement. Full performance is considered met when these efforts are reasonably applied.

SPECIFIC EXCLUSIONS:

This agreement does not cover:

Pests not included in the selected service plan, including but not limited to bed bugs, termites, wood-destroying organisms, and mold;

Injuries or damage caused by biting or stinging pests;

Harm resulting from the customer's failure to follow pre- or post-service instructions;

Injuries or property damage caused by pest-related materials such as feces, urine, or carcasses;

Damage to landscaping, sprinklers, or structures that interfere with services;

Odors or damage from pest decay in inaccessible areas (e.g., attics, walls);

Harm to animals or pets due to contact with pest control materials.

AUTOMATIC RENEWALS:

This agreement is valid for one year from the date of execution and will automatically renew unless written cancellation is received from the customer prior to the renewal date.

CUSTOMER RESPONSIBILITIES:

Customers must address environmental conditions contributing to pest infestations. Ban-A-Bug is not responsible for pest activity in areas where conducive conditions persist.

ACCESS TO SERVICE AREAS:

Customers must provide access to all service areas, including closets, drawers, crawlspaces, and attics. If access is denied, Ban-A-Bug may charge a return service fee.

SERVICE COMPONENTS:

Ban-A-Bug may install pest control devices or components on the property. These remain company property. Customers are responsible for lost or damaged components unless caused by Ban-A-Bug. Upon termination, Ban-A-Bug must be granted access to retrieve equipment.

CHEMICAL SENSITIVITY:

Customers or occupants who may be sensitive to pest control products must notify Ban-A-Bug in writing before service. Failure to do so constitutes an assumption of risk and waives liability. Customers agree to indemnify Ban-A-Bug for any claims arising from undisclosed sensitivities.

BINDING ARBITRATION:

All disputes will be resolved through binding arbitration under Florida law. Arbitration will occur in the county where Ban-A-Bug operates. Parties share arbitration costs equally. Legal suits are only permitted to enforce arbitration decisions.

SCHEDULING:

Ban-A-Bug will notify customers 24 hours in advance of regular services. If contact is not made, services will proceed as scheduled to the best of the company’s ability.

TERMINATION:

Ban-A-Bug may cancel the agreement if the customer:

Engages another pest control provider;

Uses unauthorized pest treatments;

Denies access to the property;

Fails to make timely payments;

Prevents Ban-A-Bug from completing contracted services.

CHANGE IN LAW:

This agreement complies with all current laws. If a legal change prevents compliance, Ban-A-Bug reserves the right to modify or terminate the agreement.

SEVERABILITY:

If any clause in this agreement is found unenforceable, all remaining clauses remain valid.

NON-PAYMENT AND LIENS:

Ban-A-Bug may pursue legal action or assign collections for unpaid balances. Customers are responsible for legal fees and interest. A lien may be placed on the serviced property if payments are delinquent.

FORCE MAJEURE:

Ban-A-Bug is not liable for service disruptions caused by events beyond its control, including natural disasters, war, pandemic, or government action.

EARLY TERMINATION:

Early termination is not permitted unless there is a documented failure of service. Customers must provide a written demand for correction. Ban-A-Bug will have five (5) days to respond and resolve. If the customer terminates without cause, a cancellation fee of $250 will apply.


BY EXECUTING THIS AGREEMENT AND/OR RECEIVING BAN-A-BUG SERVICES, CLIENT ACKNOWLEDGES THAT IT HAS READ, UNDERSTANDS, AND AGREES TO BE BOUND BY ALL OF THE TERMS OF THE AGREEMENT.
